These Terms and Conditions (“Terms”) govern your use of the Vortex Steel Welders website (vortexsteel.co.za) and any enquiry, quotation, fabrication or installation services you request from Vortex Steel Welders (“we”, “us”, “our”), based at 91 Somtseu Rd, Durban, 4001, South Africa. By using this website or submitting an enquiry form, you agree to these Terms and our Privacy Policy.

Vortex Steel Welders provides custom metal fabrication and related services including, without limitation, driveway sliding gates, security gates, burglar bars, balustrades, steel staircases, carports, structural steelwork and industrial welding across eThekwini / Greater Durban and surrounding areas.

2. Website use

Content on this website is provided for general information. Photographs, dimensions, finishes and lead times are illustrative. Specifications for your project are confirmed only in a written quotation after site measurement (where required).

You agree not to misuse the site, attempt to disrupt it, scrape it excessively, submit malicious or automated spam, or use our contact tools for unlawful purposes.

3. Enquiries, quotes and contact consent

When you submit a form or message us, you confirm that the information you provide is accurate and that you are authorised to make the enquiry. You expressly consent to us contacting you by telephone, WhatsApp, SMS and/or email regarding your enquiry, quotation, project updates, scheduling and related aftercare.

Quotes are typically estimates until measurements, material selections and site conditions are confirmed. Prices, timelines and scope in a formal quotation supersede any website or WhatsApp ballpark figures.

Quotes are valid for the period stated on the quotation (or 14 days if none is stated), unless withdrawn earlier due to material price changes or scope changes.

4. Orders, deposits and payment

Work generally proceeds after written acceptance of a quotation and payment of any required deposit. Deposits are applied to the project price. Progress or final payments are due as set out in the quotation or invoice.

Title to fabricated goods remains with Vortex Steel Welders until paid in full. We may suspend fabrication or installation if payments are overdue.

Accepted payment methods will be confirmed on invoices. Bank details will only be provided through our verified contact channels.

5. Measurements, fabrication and installation

Accurate site access, clear working areas and timely decisions on design/finish are your responsibility. Delays caused by access restrictions, incomplete information, third-party trades, weather, municipal or estate approvals, or changes requested after fabrication has started may affect price and programme.

Structural advice beyond normal fabrication practice may require an engineer; we are not a registered professional engineering practice unless expressly agreed in writing.

Coastal and high-humidity environments (common in KZN) accelerate corrosion. We will recommend suitable finishes, but ongoing maintenance (cleaning, touch-ups) remains the client’s responsibility after handover.

6. Variations and cancellations

Changes to design, size, finish or site conditions after acceptance may require a revised quote. If you cancel after fabrication has begun, you remain liable for costs incurred, including materials, labour and a reasonable cancellation charge, subject to applicable consumer law.

7. Warranties and limitations

We warrant that workmanship will be carried out with reasonable skill and care. Manufacturer warranties on bought-in components (e.g. gate motors if supplied by third parties) are subject to those manufacturers’ terms.

To the fullest extent permitted by South African law (including the Consumer Protection Act 68 of 2008 where applicable), we are not liable for indirect or consequential loss, loss of profit, or delay losses. Our aggregate liability for any claim relating to a project is limited to the amount paid to us for that project, except where liability cannot be limited by law (including for death or personal injury caused by our negligence, or fraud).

Defects caused by misuse, lack of maintenance, third-party alterations, impact damage, or environmental exposure beyond recommended finishes are excluded.

8. Health, safety and site rules

Clients must disclose known hazards and provide safe access. We may refuse to work where conditions are unsafe. Hot works (welding/grinding) require clearances and fire precautions; estate or building management rules must be followed.

9. Intellectual property

Website content, branding, photographs and custom drawings prepared by us remain our intellectual property unless otherwise agreed. You may not copy or reuse our content for commercial purposes without written consent.

10. Privacy

Personal information is processed under our Privacy Policy and applicable South African data protection law (including POPIA).

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. Courts of KwaZulu-Natal (or other competent South African courts) shall have jurisdiction, without limiting any consumer rights to approach the National Consumer Commission or applicable ombuds.

12. Changes

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the website after changes constitutes acceptance of the updated Terms.
